HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 1306 OF 2017 ORDER:

It is submitted by both learned counsel that the issue raised in this writ petition is squarely covered by the judgment of this Court in W.P.No.39888 of 2015, dated 09.12.2015.

In view of the above, this Writ Petition is disposed of following the decision of this Court in W.P.No.39888 of 2015 dated 09.12.2015 with a direction to 2nd respondent to consider for release of the seized vehicles. Since the petitioner has already submitted his application to 2nd respondent, he is directed to consider the same and pass appropriate orders as per G.O.Ms.No.3, Industries and Commerce (Mines.I) Department, dated 08.01.2015 as amended by G.O.Ms.No.5, Industries & Commerce (Mines.I) Department, dated 19.02.2015 for release of the seized vehicles within a period of three days from the date of receipt of a copy of this order. Miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
