HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.C.M.P.No.638 of 2015 ORDER:
This petition is filed to withdraw O.P.No.1117 of 2014 from the file of Family Court, City Civil Court, Hyderabad and transfer the same to Family Court, Nizamabad.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 19.01.2013 at Vyas Bhavan, Marriage Function hall, Gurubabadi Road, Nizamabad, as per Hindu Rites and custom. She stated that she was not allowed to talk with her parents and was harassed by the family members of respondent and that she was treated as maid servant in their house but not as a daughter-in-law, and due to differences, she was staying at her parents' house in Nizamabad. She stated that respondent filed petition for conjugal rights before Family court, Hyderabad and that she filed petition for maintenance before Family court, Nizamabad, which is numbered as M.C.No.320 of 2015. She further stated that it is financially difficult for her to travel from Nizamabad to Hyderabad for defending O.P.No.1117 of 2014, as her father is a retired person and managing the family with meager pension. She further stated that she was terrified by respondent family members and she is apprehending danger at Hyderabad.
For these reasons, she prayed for transfer of O.P.No.1117 of 2014 from Family Court, Hyderabad to Family Court, Nizamabad.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

5. Considering the reasons stated in the affidavit filed in support of the petition and also considering the fact that M.C. filed by wife is already pending before Family Court, Nizamabad, request of wife for transfer of O.P.No.1117 of 2014 from Family Court, Hyderabad is considered.
6. For these reasons, O.P.No.1117 of 2014 is withdrawn from the file of Family Court, City Civil Court, Hyderabad and transferred to Family Court, Nizamabad for disposal in accordance with law.
7. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, pending in this petition, if any, shall stand closed.
