..

Petitioner And State of Telangana, Rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad & Others.

.. Respondents This court made the following :

- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29423 OF 2017 ORDER :

Heard.

2.

Petitioner claims to be the owner and in possession of the land in Sy.No.1011 to an extent of Ac.1.34 guntas, Sy.No.1010 to an extent of Ac.1-05 guntas, Sy.No.1007 to an extent of Ac.1-21 guntas and Sy.No.1012 to an extent of Ac.1-20 guntas, situated at Ameenpur Village and Mandal, Sanga Reddy District. Petitioner claims that she owned 1/3rd of the said extent of lands. Petitioner intends to mutate her name in the revenue records in respect of her share. Requesting to enter her name in the revenue records, a representation was made on 03.06.2017 addressed to the District Collector, Revenue Divisional Officer, and Tahsildar, Sanga Reddy District. Alleging in action on the said representation, this writ petition is filed.

3.

Though petitioner claims that she is entitled to mutate her name in the revenue records, apparently no application as required by the A.P. Rights in Land and Pattedar Pass Books Act 1971 (for short 'the Act, 1971') and Rules made thereunder is made so far, except submitting a representation. Since no such application is filed as required, it cannot be said that the respondent authorities are not acting on the said representation and a direction be issued. 4.

Thus, leaving it open to the petitioner to make an application as required by the Act, 1971 and the Rules made thereunder, the writ petition is disposed of. It is needless to observe that as and when such an application is made, the Tahsildar, Ameenpur

- 3 - Mandal, Sanga Reddy District (4th respondent) shall consider the same and take appropriate decision as required by law, by following the due procedure and communicate the same to the petitioner, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
