HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.253 of 2014 ORDER:

This petition is filed to withdraw O.S.No.150 of 2010 from the file of VIII Additional District Judge (FTC), Vijayawada, Krishna District and transfer the same to Family Court, Vijayawada for disposal along with E.A.No.41 of 2010 in E.P No.6 of 2009 in O.S.No.138 of 2000.

No representation is made on behalf of transfer petitioners.

Advocate for respondents submitted E.A.No.41 of 2010 was dismissed on 16.06.2014 and petitioners filed C.R.P. against said order and the same is pending as C.R.P.No.3361 of 2014 therefore present transfer O.P has become infructuous. He submitted with regard to Crl.M.P.No.2851 of 2008 in DVC No.6 of 2008, DVC is not before Family Court and it is before I Additional Chief Metropolitan Magistrate, Vijayawada and for that they have to file separate petition and transfer O.P is not maintainable.

4. Recording the submission of advocate for respondents, this Transfer Miscellaneous Petition is dismissed as infructuous. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
