THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CIVIL REVISION PETITION No.3543 of 2015 ORDER:

This revision is preferred against the interim order passed on 09.07.2015 in I.A.No.162 of 2015 in O.S.No.455 of 2009 on the file of Additional Junior Civil Judge - cum - XVII Metropolitan Magistrate, Cyberabad at Rajendranagar. The said I.A.No.162 of 2015 is preferred by respondent Nos.1 and 2 herein to bring them on record as legal representatives of Smt.Yousuf Begum, the 2nd defendant in the suit.

Heard Sri Mirza Nisar Ahmed Baig Nizami, learned counsel for the petitioner. When there is no serious dispute between the relationship of the applicants and the deceased Smt.Yousuf Begum, the question of opposing such an application, in my opinion, is a fruitless exercise. The essential grievance of the petitioners herein appears to be that the civil suit, which is instituted in the year 1995 and numbered as O.S.No.244 of 1995 by the Principal Junior Civil Judge (West & South) Ranga Reddy District at Saroornagar is getting dragged, on one pretext or the other for the past 20 years without seeing the end of it.

It is, therefore, appropriate that the Additional Junior Civil Judge - cum - XVII Metropolitan Magistrate, Cyberabad at Rajendranagar is directed to deal with the suit, which is now renumbered as O.S.No.455 of 2009 on out of turn basis and dispose of the same before 31.12.2015 on merits as it is a suit pertaining to the year 1995 though re-numbered in 2009.

With this, the Civil Revision Petition stands disposed of. No order as to costs. The miscellaneous applications, if any shall also stand closed.
