HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 34804 of 2018 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the inaction of the 2nd respondent in taking appropriate decision on the representation dated 17.09.2018 made by the petitioner seeking to appoint her as Anganwadi Teacher for R.Ummadivaram Village, Pullalacheruvu Mandal, Prakasam District, which fell vacant due to resignation of her co-sister to the said post, as illegal and arbitrary. A consequential direction is also sought to direct the respondents 2 and 3 to consider the case of the petitioner for appointment to the said post.

Heard Sri I. Koti Reddy, learned counsel for the petitioner, and learned Government Pleader for Women and Child Welfare appearing on behalf of the respondents. With the consent of both parties, this writ petition is disposed of at the admission stage. It is the case of the petitioner that in the year 2009, the 2nd respondent appointed her co-sister Ms. K. Saraswathi as Anganwadi Teacher for R.Ummadivaram Village, Pullalacheruvu Mandal, Prakasam District under O.C. category. Due to the resignation of her co-sister to the said post, she submitted a representation to the respondents on 17.09.2018 seeking to appoint her as Anganwadi Teacher in the resultant vacancy. The grievance of the petitioner is

that the respondents have not passed any orders on her representation so far.

Learned Government Pleader for Women and Child Welfare has contended that there is no such procedure to appoint the petitioner in the resultant vacancy and the said vacancy will be filled up only by way of issuing a fresh notification.

This Court, having considered the submissions made by the parties and perused the record, is of the considered view that ends of justice would be met, if the writ petition is disposed of with a direction to the respondents to consider the representation of the petitioner.

Accordingly, the writ petition is disposed of directing the respondents to consider the representation of the petitioner dated 17.09.2018 and pass appropriate orders thereon, in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
