THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3364 OF 2015 ORDER:
The petitioner/A.1 has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 09.12.2015 passed in Crl.M.P.No.462 of 2015 in S.C.No.462 of 2012 by the Court of the I Additional District and Sessions Judge, East Godavari at Rajahmundry, whereby the learned Judge dismissed the petition filed by the petitioner seeking to discharge him from the proceedings initiated against him. Heard and perused the material available on record. Learned counsel for the petitioner submits that the Court below erroneously dismissed the application of the petitioner seeking to discharge him in S.C.No.462 of 2012.
On perusing the order impugned, this Court is of the view that the Court below rightly dismissed the petition filed by the petitioner to discharge him from the proceedings initiated against him by observing that the charges were also framed in the case and as such, at that stage, the petitioner is not entitled to seek discharge. The order of the Court below is in accordance with law and needs no interference by this Court.
The Criminal Revision Case is accordingly dismissed. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 05.01.2016 pln
