ORDER :

Petitioner is a Conductor. By the order impugned, he was placed under suspension on the allegation of cash and ticket irregularities. On the same day, petitioner was also served with charge memo on the said allegations.

Prima facie, reading of the order would show that the disciplinary authority was convinced of the allegations against the petitioner on cash and ticket irregularities and has initiated disciplinary action against him. Pending enquiry, he was placed under suspension. There is no dispute that the Depot Manager is the disciplinary authority. Thus, competence is not in doubt. Having regard to the allegations made and charge memo is already issued, Court is not inclined to entertain the writ petition at this stage.

At this stage, both counsel agreed for disposal of the writ petition by fixing time limit for completion of disciplinary action. 4.

Having regard to the said submission, writ petition is disposed of, directing the disciplinary authority to complete the disciplinary action within a period of two months from the date of receipt of explanation from the petitioner. Petitioner shall cooperate for early disposal of the disciplinary action. For any reason, petitioner is not co-operating, it is open to the disciplinary authority to take further action. Petitioner shall submit his explanation within a period of one week from today.
