HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10623 OF 2017 ORDER:

The Writ Petition is filed seeking release of seized vehicle bearing No. AP 28 AV 5495 (Ford Fiesta) in connection with COR No.47 of 2017 under Section 34 (a) of the A.P Excise Act, 1968.

It is the case of the petitioner that, while she, along with her husband, was returning to Zaheerabad after attending function at Bidar, Karnataka, the excise officials seized the subject vehicle along with liquor bottles and registered a case in COR No.47 of 2017 under Section 34 (a) of the Act.

Heard the learned Government Pleader for Prohibition and Excise (Telangana State).

Having considered the submission made by the learned counsel for the petitioner and the learned Government Pleader, the writ petition is disposed giving liberty to the petitioner to approach respondent No.3 (Deputy Commissioner, Prohibition and Excise, Sanga Reddy, Telangana District) who shall consider her representation dated 17.03.2017 for grant of interim custody of seized vehicle or pass final orders within a period of one week from the date of receipt of a copy of the order.

With the above direction, the writ petition stands disposed of. No order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
