THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.4075 OF 2016 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner states that he purchased Ac.1.00 of land in Survey No.1178 of Aswaraopet Village and Mandal, Khammam District. He made a representation in January, 2015 to the Tahsildar, Aswaraopet Mandal, the 2nd respondent, for grant of pattadar passbook and title deeds by enclosing the registered sale deed and copy of encumbrance etc. Since no action is taken by the 2nd respondent, the petitioner is stated to have made further representation dated 07.02.2015 to the Sub-Collector and also the District Collector, Khammam District, and the latter addressed a letter to the 2nd respondent on 18.02.2015 to take necessary action. Alleging that no action is taken by the 2nd respondent though the petitioner has once again made representation on 10.03.2015, the present Writ Petition is filed.
It is apparent from the averments, as stated above, as well as the record that the petitioner has neither made an application under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short, 'the Act') and the Rules framed thereunder nor paid the requisite fee in Mee-Seva. Hence, on the basis of the representations filed by the petitioner, the relief as sought for by him cannot be granted. However, the petitioner is at liberty to make appropriate application in accordance with the Act and the Rules as aforesaid and if such an application is received, the 2nd respondent shall consider the same and pass appropriate orders within a period of two months from the date of receipt of a copy of this order.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
