HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 5091 OF 2015 ORDER:

This Writ Petition is filed challenging the action of first respondent in not disposing of Complaint SR.No.124 of 2014, dated 18.11.2014.

The learned Counsel appearing for the first respondent filed a counter affidavit stating that the complaint of the petitioner was registered as Complaint SR.No.124 of 2014 and notice was issued on 31.12.2014 calling for comments from the second respondent. Pursuant to the same, the second respondent filed his comments by duly serving a copy of the same on the complainant/petitioner. The complainant also filed his rejoinder on 11.2.2015 with new allegations. A reply to rejoinder was also filed by the second respondent on 24.03.2015.

Thereafter the matter was placed before the General Body meeting held on 25.4.2015, on which day, the same was deferred to the next meeting to be held on 23.08.2015. On that day, it appears that the complaint of the petitioner was considered and rejected as no prima facie case was made out by the petitioner.

In view of the above, the Writ Petition is dismissed as having become infructuous. However, it is left open for the petitioner to avail appropriate remedies available under law. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
