Heard Sri Prabhakar Bommagani, learned counsel for the petitioner.

Learned counsel would submit that a Maintenance Case and a Criminal Case for the offence punishable under Section 498-A of I.P.C. against the respondent are pending on the file of Nalgonda local Courts, and it is difficult for the petitioner to travel from Nalgonda to Siddipet, Medak District, to attend H.M.O.P. No.148 of 2013. When notice was sent to the respondent-husband, he refused to receive notice, according to the endorsement made by the Registry. In such an event, to avoid hardship to the petitioner, the request made by her can be acceded to.

Accordingly, the Transfer Civil Miscellaneous Petition is allowed withdrawing H.M.O.P. No.148 of 2013 on the file of Senior Civil Judge, Siddipet, and transferring the same to the file of Family Court-cum-Additional District Judge, Nalgonda. The transferee Court shall issue notices to the parties and then proceed with further proceedings. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions if any pending in the Transfer Civil Miscellaneous Petition shall stand closed. ________________________ A.SHANKAR NARAYANA Dt. 09.04.2018 gbs
