THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY C.R.P.No.859 OF 2002 ORDER:

This Civil Revision Petition is filed against the order dated 20.11.2001 in E.A.No.1010 of 1996 in O.P.No.49 of 1986 on the file of the Principal Senior Civil Judge, Vijayawada.

2. E.A.No.1010 of 1996 was filed by claimant No.4 in the aforesaid O.P. praying the Court below to issue a cheque for Rs.1,01,655/- from out of the compensation amount and the same was dismissed. Challenging the same, the present Revision Petition is filed.

3. This Court need not go into the merits of the order passed in E.A.No.1010 of 1996 in O.P.No.49 of 1986, which is under challenge in this Revision, in view of the judgment dated 17.8.2015 in A.S.No.2819 of 1996.

4. The trial Court is directed to decide the cheque petition in terms of the decree and entitlement of the parties thereto, in view of judgment in A.S.No.2819 of 1996.

5. With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs.
