O R D E R:- The main grievance of the writ petitioner is that the official respondents, without issuing any notice and without following the procedure contemplated under Record of Rights Act and the Rules made therein, are trying to take steps to effect mutation in favour of the 6th respondent who is his sister, in the revenue records in respect of their ancestral land in an extent of Ac.4.96 cents in Sy.Nos.463/1, 463/2 and 558/4 situated in Mannepally Revenue (v), Taluru Mandal, Prakasam District. Hence, the present writ petition is filed seeking appropriate directions.

The learned Government Pleader for Revenue, on instructions, has submitted that there is an internal dispute between the petitioner and the 6th respondent and essentially this is a civil dispute and in fact a suit in O.S.No. 159 of 2009 on the file of the Court of the Junior Civil Judge, Darsi is pending adjudication.

In view of the submission made by the learned Government Pleader that the matter is purely of civil nature, and the fact that suit filed before the trial Court is pending adjudication, this Court is not inclined to go into the merits of the case, but deems it appropriate to

dispose of the writ petition with the following direction: "The 4th respondent-Tahsildar is directed not to deal with the matter relating to grant of pattas in respect of the land in question till such time as the petitioner and the 6th respondent resolved their claims in the civil Court".

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous. ______________________ CHALLA KODANDA RAM, J 27.01.2015 bcj
