ORDER
Heard learned counsel for the petitioner, learned Government Pleader for Revenue for respondents 1 to 4 and learned Government Pleader for Home for respondents 5 and 6.
2. This writ petition is filed with the following prayer; "to issue a writ, order or direction, more particularly a writ of mandamus declaring the action of the respondents in unlawful interference while digging bore well and trying to install pipe fittings and pump set unauthorisedly trespassing into the private patta lands of the petitioner in the part of the land to an extent of Ac.263-29 cents in Sy.No.1120 situated at Potapolu Revenue Village, Madanapalle Mandal, Chittoor District, without right, title and interest and without following due procedure contemplated under law, as arbitrary, illegal and mis-use of exercise of powers vested with them and to pass such other order or orders".
3. Learned Assistant Government Pleader for Home has produced instructions stating that the respondents proposed to dig a bore well in the land in Sy.No.1124, which belongs to the Government and they never trespassed into the patta land of the petitioner in Sy.No.1120. He also produced a letter addressed by the Sarpanch, Gram Panchayat, to the Circle Inspector seeking police protection for digging bore well in the Government Land.
4. In view of the aforesaid instructions that the respondents proposed to dig bore well in the Government land, I am not inclined to entertain the present writ petition. Hence, the writ petition is closed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
