THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11506 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "...to issue a writ, order or directions more in the nature of writ of 'Mandamus' declaring the Office order No.E1/255(1)/2010-NSPT, dated 13.07.2010 passed by the 3rd respondent herein in not providing alternative employment as Record Tracer as illegal, arbitrary and contrary to Circular No.PD 09/2009, dated 04.03.2009 of the 1st respondent and set aside the same in so far against to the petitioner with all consequential benefits including providing record tracer post in place of 'Shramic' post in the interest of justice and pass such other order or orders as otherwise, petitioner may put irreparable loss and hardship."

Heard learned counsel for the petitioner and Sri B.Mayur Reddy, learned Standing Counsel for the respondent Corporation.

When the matter is taken up, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 15.02.2013 to the 2nd respondent herein and no orders have been passed in the said representation so far and a copy of the same is also placed on record. It is further requested by the learned counsel that necessary direction may be issued to the 2nd respondent to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe.

The said request is not opposed by the learned Standing Counsel for the Corporation. On the other hand he submits that the said representation would be considered in accordance with law. 5.

Recording the said submission and having regard to the nature of controversy, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioners, directing the 2nd respondent herein to consider and pass appropriate orders on the representation dated 15.02.2013 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
