THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9388 OF 2016 ORDER:

This Criminal Petition is filed by the petitioner/sole accused under Sections 437 and 439 of the Code of Criminal Procedure, 1973 seeking to grant bail in S.C.No.39 of 2016 on the file of the I Additional District and Sessions Judge, Rajahmundry, East Godavari District.

2. Heard and perused the material available on record.

3. The petitioner is the accused in Crime No.4 of 2016 of Yetapaka Police Station, East Godavari District, registered for the offences punishable under Section 8(c) read with 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

4. The petitioner was found in possession of 90 kgs. of ganja illegally.

Since the ganja found is commercial quantity and considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.
