THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4764 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioner/A-1 seeking to modify the order, dated 19.1.2016, passed in Crl.M.P.No.131 of 2016 in C.C.No.116 of 2015 on the file of the XIV Metropolitan Magistrate, Cyberabad at L.B.Nagar and permit him to join his job at Singapore pending disposal of the Criminal Petition.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioner are punishable under Section 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

4. Vide impugned order, the petitioner was directed not to leave the country without prior permission from the Court. Case of the petitioner is that he is working at Singapore and if he do not report to his duty at Singapore, he would be terminated from the project and that he is also paying maintenance to the de facto complainant. Hence, he prays to relax the said condition and permit him to join his job at Singapore.

5. Considering the facts and circumstances of the case, the petitioner is directed to file an application before the Court concerned seeking permission to leave abroad and on such application being filed, the Court concerned is directed to consider the same and pass orders in accordance with law.

6. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed. _________________________ JUSTICE RAJA ELANGO
