SMT JUSTICE T.RAJANI CRIMINAL PETITION No.10261 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.5, in Crime No.50 of 2018 on the file of Station House Officer, Rapur Police Station, S.P.S.R. Nellore District. 2.

The offences alleged are under Sections 143, 144, 452, 324, 332, 353, 307, 395, 120-B, 147 and 148 R/w.149 of I.P.C. and Section 3 of the Prevention of Damage to Public Property Act, 1984.

Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondent-State and perused the record. 4.

As per the case of prosecution, more than 30 persons, including the petitioner, herein trespassed into the Rapur Police Station and beat the SubInspector of Police and Staff therein. 5.

Learned counsel for the petitioner submits that the petitioner is a Junior Lecturer in a Junior College.

But, the said fact is opposed by the learned Public Prosecutor saying that the cause title does not describe the petitioner as Junior Lecturer. 7.

Learned counsel for the petitioner submits that, in the Petition, it is mentioned that the petitioner is an employee. But, somehow, without there being any proof that the petitioner is an employee in the Junior College, it cannot be believed that the petitioner is employed.

Hence, in view of the above, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner/accused No.5 is directed to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application, expeditiously, preferably on the same day, subject to pressure of other work.

Accordingly, with the above observation, this Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
