HONOURABLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No. 11416 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Rc.No.CWC/ATP/05/2016, dated 17.5.2016 on the file of the learned Child Welfare Committee (CWC), Ananthapuram District.

Having heard the learned Counsel for the petitioner as well as learned Public Prosecutor representing the State and having perused the record, I do not see any valid reason to quash the proceedings in Rc.No .CWC/ATP/05/2016, dated 17.5.2016 on the file of the learned Child Welfare Committee, Anatapuram District. However, it is left open for the petitioner to approach the competent authority by filing an appropriate application seeking custody of the child. If such an application is filed, the same shall be disposed of in accordance with law, within a period of two weeks from the date of filing the said application,.

The Criminal Petition is disposed of accordingly. Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. No order as to costs.
