THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3180 of 2010 ORDER:

This writ petition was filed for the following relief: "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring inaction of the respondent in not according permission to the petitioner to enjoy the remaining lease period in the first year in respect of Chevitikallu Sand Reach, Kanchikacherla Mandal, Krishna District despite the fact that there is no mistake on its part and the respondent failed to issue waybills, as arbitrary, illegal, failure to exercise power vested with the respondent, discriminatory, violative of the procedure contemplated under the A.P. Minor Mineral Concession Rules, 1966, violative of Articles 14 and 19 of the Constitution of India and consequently direct the respondent to accord permission to the petitioner to enjoy the remaining lease period in 1st year and receive the 2nd year lease amount, execute the lease deed."

The lease period in favour of the petitioner expired long back and nothing survives for consideration in this writ petition. Accordingly, this Writ Petition is dismissed as infructuous. No order as to costs.

However, this order will not prevent the petitioner from agitating his rights, if any, consequent to the lease in appropriate proceedings in accordance with law.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
