HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.39173 OF 2013 ORDER:
This writ petition is filed seeking a writ of Mandamus, declaring the action of the respondents in not extending the prerevised pay scales of the year 1998, 2005 and 2010 to the petitioners, as violation of principles of natural justice and unconstitutional and sought a consequential direction to the respondents to take immediate action for implementation and sanction of pre-revised pay scales accorded by the Government during the year 1998, 2005 and 2010 to the petitioners.
Heard learned counsel for the parties.
It has been contended by the petitioners that they are working as Work Inspector and Watchman, respectively, for the last 25 years. The grievance of the petitioners is that though they are discharging their duties, the respondents are not extending pre-revised pay scales of the year 1995, 2005 and 2010 to them.
Therefore, counsel for the petitioners submitted that appropriate orders be passed in the writ petition directing the respondents to extend pre-revised pay scales of the year 1995, 2005 and 2010 to the petitioners within a reasonable period of time. Government Pleader as well as Standing Counsel appearing for the respondents submitted that the case of the petitioners would be considered and appropriate orders would be passed in accordance with
law, if only the petitioners submit a representation afresh seeking revised pay scales.
This Court, having considered the rival submissions made by learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the petitioners to submit a representation afresh to the respondents 1 and 2 staking their claim for grant of pre-revised pay scales in accordance with Rules within a period of two weeks from the date of receipt of a copy of this order. Upon such representation being received, the respondents 1 and 2 shall consider the same and pass appropriate orders in accordance with law in another eight weeks thereafter.
With the above directions, the writ petition is disposed of. No order as to costs.
