HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.26243 OF 2010 ORDER:

The petitioners seek writ of Mandamus declaring the action of respondents in deducting the crop insurance premium from the crop loans of the petitioners released and to be released to the petitioners at the rate of 1% to 12% towards crop insurance premium in the Kharif and Rabi seasons, 2010-2011 as illegal, arbitrary and violative of provisions of the Constitution of India, Contract Act and declare the same as optional.

Today, the matter is listed under the caption 'for dismissal' and in spite of the same, there is no representation for the petitioners. It appears the petitioners are not interested to prosecute the matter. Added to it, since the relief sought for is in respect of the crop period of 2010-2011, which was over long back, the writ petition became infructuous.

Recording the said submission, this writ petition is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
