THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34794 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.

When the matter is taken up, written instructions, dated 29.10.2018, furnished by the Sub Inspector of Police & Station House Officer, Nandivada Police Station, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, are as under: "In view of the facts and circumstances stated above, all the allegations of the petitioner in the writ petition about not investigating in FIR No.14/2016, not recording the statements of witnesses etc., are all false, baseless and an after-thought, which are hereby specifically denied. As stated supra, basing on the complaint of the petitioner herein, Cr.No.14/2016, dt.20.01.2016, u/s 409, 420 & 384 IPC, was registered on the file of the Nandivada police station, against the 5th respondent and others and investigation was taken up by the then S.I.of police, Nandivada P.S. who has completed the investigation and closed the same as 'false' as per the orders of the SDPO, Gudivada vide C.No.348/SDO-G/2016,dt.30.07.2016.

Thereon, the then S.I. of police, tried to serve the complainant's notice to the petitioner on several occasions, but he was not found at her residence. While being so, I have taken over charge as Sub-Inspector of police, Nandivada P.S., on 01.11.2017 and thereafter, I have also tried to serve the complainant's notice on the petitioner herein, but she was not found available at her given address. Ultimately, I have sent the complainant's notice to the petitioner through registered post on 04.10.2018, filed final report in Cr.No.14/2016 before the AJFCM Court, Gudivada, on 23.10.2018".

By placing on record the above written instructions, Writ Petition is disposed of, with a liberty to the petitioner herein to avail the remedies open under law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
