THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.3632 OF 2017 ORDER:
This writ petition is filed seeking a Writ of Mandamus to declare the action of the respondents in not considering the representation dated 13.6.2016 submitted by the petitioner seeking appointment as Vatandar of Kamareddy village and Mandal, even after lapse of two months as arbitrary and illegal. A consequential direction is sought to consider the representation of the petitioner, dated 13.6.2016 and pass appropriate orders.
Heard Sri V.Brahmaiah Chowdary, learned counsel for the petitioner and learned Government Pleader for Services-II for the respondents. It is the case of the petitioner that the grand father of the petitioner had worked as Vatandar and the petitioner had passed 10th Class and he is fully eligible and qualified to be appointed as Vatandar and he has submitted a representation on 13.6.2016 to appoint him as Vatandar. Since the respondents had not passed any orders on the representation, the petitioner filed this writ petition seeking a direction to the respondents to dispose of his representation, dated 13.6.2016 and to appoint him as Vatandar. Learned Government Pleader, Services-II contends that the post of Vatandar has been abolished and the respondents are going to issue a notification for direct recruitment to the post of Village Revenue Assistant
and as per the latest recruitment rules, a notification must be issued and all the aspirants will be subjected to written test and interview. In view of the same, the case of the petitioner cannot be considered for appointment to the post of Village Revenue Assistant directly without undergoing the process of selection.
As the post of Vatandar has been abolished, no direction can be issued to the respondents to appoint the petitioner as Vatandar. At best a direction can be issued that as and when the respondents issue a notification for recruitment to the post of Village Revenue Assistant, the petitioner can also respond to the said Notification.
The writ petition is disposed of with the above observation. No order as to costs.
Miscellaneous petitions pending, if any, in the writ petition shall stand closed.
