THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22593 OF 2016 ORDER:

In this writ petition, the petitioner assails the notice No.B/87/2016, dated 04-02-2016 issued in Form-II of Rule 3 of the AP Assigned Lands (Prohibition of Transfers) Rules, 2007, requiring him to file his explanation as to why he should be evicted from the land admeasuring Ac.1-20 guntas situated in Sy.No.132/1, Garepalli village shivar, Kataram Mandal, Karimnagar District. The case of the petitioner is that he is in possession of the land in question being the successor from his ancestors. That the land is not assigned land and he has not violated any of the provisions of the AP Assigned Lands (Prohibition of Transfers) Act, 1977. However, it is stated that he has submitted detailed reply to the impugned notice on 0902-2016, but no orders have been passed till date.

3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

4. Inasmuch as the petitioner has already said to have submitted his explanation to the impugned notice dated 0402-2016, the writ petition is disposed of directing the 2nd respondent-Tahsildar, Kataram Mandal, to consider the explanation submitted by the petitioner on 09-02-2016 and pass appropriate orders thereon, in accordance with law, expeditiously, after affording opportunity of being heard in the matter to the petitioner. Till then, the petitioner shall not be dispossessed from the land in question. Miscellaneous

petitions, if any, pending in this writ petition shall also stand disposed of. No order as to costs.
