HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.24224 of 2017 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to direct the respondents not to dispossess the petitioner from his land of an extent of Ac.2.29 cents in Sy.No.325 situated in Bandlapalle Village, Bandlapalle Gram Panchayat, Ramapuram Mandal, Y.S.R. Kadapa District, under the guise of road widening and construction of a tollgate.
It is the case of the petitioner that he is the absolute owner of the subject land and that on 15.7.2017, the respondents visited his land and made some markings in his land. On enquiry, it was informed that the respondents identified his land for construction of a toll gate and in that connection, they visited his land. The respondents are trying to dispossess the petitioner, without following the due procedure. Hence, the petitioner filed this writ petition.
Heard and perused the material available on record. The main grievance of the petitioner is that the respondents are trying to interfere with his land and to dispossess him, without following the due process of law.
Considering the circumstances of the case and the grievance of the petitioner, this Court is inclined to pass the following order: " The respondents are directed to follow the due process of law, if they intend to acquire the land of the petitioner for
the purpose of construction of a toll gate, provided if the land belongs to the petitioner."
Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
