HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.122 of 2012 ORDER:

The relief, sought for in this Writ Petition, is for a mandamus to declare the action of the respondents in not processing/ considering the application of the petitioner-school for recognition, even after fulfilling the requirements under the Andhra Pradesh Educational Institutions (Establishment, Recognition, Administration and Control of Schools under Private Management) Rules, 1993, as illegal and arbitrary.

In the counter-affidavit, filed on behalf of the respondents, it is stated that the premises, where the petitioner-school was proposed to be opened, was inspected; and the proposals are under examination. It is not known what transpired after the said counter-affidavit was filed.

By way of interim relief, the petitioner sought a direction to the respondents not to interfere with the day-to-day activities of the petitioner-school, directing the respondents to consider the application of the petitioner. This Court, by its order in WPMP No.153 of 2012 dated 04.01.2012, granted interim direction as prayed for. The interim order was to direct the respondents not to interfere with the day-to-day activities of the petitioner-school, and to direct the respondents to consider the petitioner's application for recognition. It is not known what transpired thereafter. Suffice it, therefore, to direct the respondents, in case the petitioner's application has not been considered so far, to consider the same, and pass orders thereupon with utmost expedition and, in any event, within three months from the date of receipt of a copy of this

order. It is open to the respondents, after such an order is passed, to take necessary action thereafter in accordance with law. In case any order has already been passed, rejecting the petitioner's application for recognition, it is open to the respondents to take necessary action, pursuant thereto, in accordance with law. The Writ Petition stands disposed of accordingly. The Miscellaneous Petitions pending, if any, shall also stand closed. No order as to costs.
