HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 30627 OF 2015 O R D E R :

This writ petition is filed by the petitioner to declare the action of the respondents in planning to dispossess or demolish the house plot bearing No. 15/C in JLR SY.NO. 481/268/Part situated at Fisherpura, Secunderabad without due process of law, as illegal, arbitrary and violation of Article 14, 19 and 21 of the Constitution of India and consequently to direct the respondents not to dispossess or demolish or the house from Plot No. 15/C in JLR.SY.NO.481/268/Part situated supra and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned standing counsel for the first respondent and placed orders dated 18-06-2013 passed in I.A.No. 1317 of 2013 in A.S.No. 39 of 2013 by the I-Additional Chief Judge, City Civil Court, Secunderabad and the judgment dated 16-11-2015 passed in A.S.No. 39 of 2013 on the file of the Court of I-Additional Chief Judge, City Civil Court, Secunderabad, wherein categorically the petitioner herein is the plaintiff in the proceedings before the court below and sought for the relief therein.

3. In view of the same, nothing survives in this writ petition for adjudication and more so serious cognizance is taken by this Court with regard to the suppression of facts. The petitioner has

filed the affidavit on 16-9-2015 and whereas the petitioner, who is the plaintiff has filed the suit in June 2013 itself. No such, information is stated in the writ affidavit. Hence, this writ petition is dismissed.

4. In the result, the writ petition is dismissed. No costs.

5. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
