Heard learned counsel for the petitioner and learned Standing Counsel for the 1st respondent. 2.

This writ petition is filed alleging inaction of the Gram Panchayat in sanctioning the building plan for construction of house in D.No.66/2A/A in Sy.No.756/1 of Nadikudi Gram Panchayat, Dachepalli Mandal, Guntur District. Alleging inaction of the Gram Panchayat in sanctioning the building permission, several complaints are filed to the higher authorities including the District Collector. But so far no action is taken and building permission is not sanctioned.

Along with the writ petition paper book, no material is filed evidencing filing of application before the Gram Panchayat, for sanction of building permission by complying the due formalities.

Learned Standing counsel representing the Gram Panchayat filed counter affidavit deposed by the 1st respondent. In Paragraph No.7 of the counter it is specifically asserted that the Gram Panchayat has not received any proposed plan from the petitioner. As such approval or rejection of the plan does not arise.

In view of the said assertion and as no material is placed on record, the contention of the petitioner that the Gram Panchayat is not taking any action on the application submitted, merits no consideration.

Accordingly, the Writ Petition is dismissed.

Notwithstanding the dismissal of writ petition, it is always open to the petitioner to file appropriate application as warranted by law, seeking permission to undertake construction. Pending miscellaneous petitions shall stand closed.
