THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20205 of 2015 ORDER:

The petitioner was appointed as a fair price shop dealer of shop No.26, Kanakanalapalli Village, Sathenapalli Mandal, Guntur District. A show-cause notice was issued to him on 20.09.2006 basing on the report of the 4th respondent dated 05.09.2006 with regard to variation of stock and other allegations. The petitioner submitted his explanation. A final order was passed cancelling the authorization of the petitioner vide order dated 28.12.2007. Aggrieved by the same, the petitioner preferred an appeal and the same was confirmed by the 2nd respondent vide order dated 24.05.2008. Challenging the same, a revision was filed before the 1st respondent. The petitioner filed W.P.No.10839 of 2009 and the same was allowed by this Court vide order dated 09.01.

2015, remanding the matter to the 3rd respondent for fresh consideration and disposal in accordance with law. Even after five months, when the matter has not been taken up for disposal by respondent No.3, the petitioner filed the present writ petition. As the petitioner has exhausted the two remedies viz., appeal and revision and in view of the remand order passed by this Court earlier, this Court is inclined to dispose of the writ petition directing the 3rd respondent to complete the enquiry pursuant to the order dated 09.01.2015 in W.P.No.10839 of 2009 within a period of 60 days from the date of receipt of a copy of this order after giving due opportunity of hearing to the petitioner and pass appropriate orders observing the principles of natural justice.

Subject to the above directions and observations, the Writ Petition is disposed of. No costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
