THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 284 OF 2017 O R D E R :

This Contempt Case is filed complaining wilful disobedience on the part of the respondents of the order dated 08.08.2016 in Writ Petition No. 25055 of 2016.

Through the order dated 08.08.2016, this Court, after noticing that the petitioner has already filed the Appeal under the A.P. Land Encroachment Act, 1905, directed the 2nd respondent therein - Appellate Authority to pass appropriate orders on merits within eight weeks from the date of receipt of a copy of that order. Counter-affidavits have been filed by the respondents. In the counter filed by the 2nd respondent, it was stated that, as a matter of fact, the Appeal of the petitioner was dismissed on 07.11.2016 itself by the 1st respondent Revenue Divisional Officer. A perusal of the said order dated 07.11.2016, a copy of which has been enclosed along with the counter, discloses that in paragraph 14, reference to the order dated 08.08.2016 passed in Writ Petition has been made.

In those circumstances, and in view of the order dated 07.11.2016 dismissing the Appeal of the petitioner, it can be said that the order complained of in this Contempt Case has been complied with. Hence, the Contempt Case is closed. Consequently, the miscellaneous Applications, if any shall stand closed.
