THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34798 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home, apart from perusing the entire material available on record.

In the present Writ Petition petitioner is questioning the action of the respondent-police authorities in not clubbing F.I.R.No.119 of 2018 on the file of the Bhonakal Police Station and F.I.R.No.234 of 2018 on the file of the I Town Police Station, Khammam together. When the matter is taken up, written instructions, dated 12.11.2018, furnished by the Inspector Police, I Town Police Station, Khammam and the Sub Inspector of Police, Bonakal Police Station, are placed on record by the learned Government Pleader. According to the above written instructions, in Cr.No.119/2018, registered on the complaint of the sixth respondent for the offence under Sections 420 and 506 IPC, charge sheet is being filed shortly before the concerned Court. It is further stated that in Cr.No.

234/2018, registered on the complaint of the unofficial respondents, for the offences under Sections 420 and 506 IPC, on completion of the investigation, police filed charge sheet into the Court of the I Additional Judicial Magistrate of First Class, Khammam, vide Inward No.3122/2018, dated 12.11.2018, and the same is yet to be taken on file by the said Court. While referring to the said instructions, it is submitted by the learned Government Pleader that, in view of the above facts, the question of clubbing the F.I.Rs now cannot be considered.

In view of the above facts and circumstances of the case, this Court, at this stage, is not inclined to grant relief in favour of the petitioner herein. However, it is open for the petitioner herein to avail the remedies open as per law.

Accordingly, Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
