HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.21025 & 30094 OF 2011 COMMON ORDER :

These writ petitions are filed challenging the proceedings vide RC No.C-3650/1998-3, dated 01-07-2011 issued by the Assistant commissioner, endowments Department, wherein date is fixed for eviction of encroachers in the subject temple as 15.07.2011 and staff were deputed to assist Manager of the subject temple for peaceful conduct of the eviction process, as per the reference 1 to 10 cited in the said proceedings. Heard Sri Ashok Reddy, learned counsel for the petitioners and Sri Sudershan Reddy, learned Standing Counsel for the 4th respondent-temple.

It is stated by Sri Sudershan reddy, learned Standing Counsel for the 4th respondent that the impugned proceedings are issued only for deputing the staff to evict the encroachers, basing on the orders of the Deputy Commissioner, Endowments Department, which are cited in the impugned proceedings as references 1 to 10. But, the said orders of the Deputy Commissioner, which are cited in the reference 1 to 10 of the impugned proceedings, does not cover the lands which are in possession of the petitioners and there are no eviction orders against the petitioners. As such, though members of the staff were deputed to conduct eviction process peacefully, petitioners are not going to be evicted. It is also stated by the learned Standing Counsel that as and when any eviction proceedings are initiated against the petitioners, 4th respondent will follow due procedure.

In view of the above submission made by the learned Standing Counsel for the 4th respondent, the writ petitions are disposed of with a direction to the 4th respondent not to evict the petitioners without following due procedure. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
