HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.10264 OF 2018 ORDER:

The petitioner is the accused in Crime No.816 of 2018 of Uppal Police Station, Rachakonda, Rangareddy District. The crime is registered for the offences punishable under Section 366-A IPC and Section 8 of the Protection of Children from Sexual Offences Act, 2012 (for short, 'the POCSO Act'). The petitioner is in judicial custody since 17.09.2018.

Heard the learned counsel for petitioner and the learned Additional Public Prosecutor representing the State of Telangana in opposing the same and perused the F.I.R., the bail application averments, the remand report of accused dated 17.09.2018 and Part I case diary.

A perusal of the F.I.R. and the remand report with reference to Part I case diary shows the prima facie accusation against the accused for the offence punishable under Section 366-A IPC if not atleast Section 366 IPC thereby and that too when the investigation is in progress, there are no grounds to consider the concession of bail.
