THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.1361 OF 2016 ORDER:

The present Criminal Petition came to be filed under Section 438 of the Code of Criminal Procedure, 1973, by the petitioner/A.5 seeking release in the event of his arrest in connection with Crime No.12 of 2016 of Rajiv Gandhi International Airport, Cyberabad, registered for the offences punishable under Sections 420, 468, 471 of the Indian Penal Code, 1860 and Section 24 of Immigration Act, 1985.

2. At the time when the matter is taken up for hearing, learned counsel for the petitioner and also the learned Public Prosecutor submit that A.1 and A.2, who are the passengers, and A.3, who is alleged to have created fake employment Visa with the connivance of A.4, were arrested and subsequently released on bail.

3. In view of the above, the petitioner shall surrender before the VIII Metropolitan Magistrate at Rajendranagar, Cyberabad, and move an application for bail after giving prior notice to the Public Prosecutor, in which event, the same shall be dealt with on the same day in accordance with law by taking into consideration the release of A.1 to A.3.
