THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.23845 OF 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed questioning the steps taken by the respondent - Bank under the provisions of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

This Court, by order, dated 31.07.2015, while issuing notice before admission, granted interim order on condition of petitioner depositing a sum of Rs.50,000/-. It is represented that pursuant to the same, the petitioner has deposited Rs.50,000/-.

When the matter was called on 26.10.2015, it is represented by the learned counsel for respondent - Bank that if the petitioner is prepared to pay Rs.1,25,000/-, the Bank is ready to regularise his account, but there was no representation on behalf of the petitioner. On 27.10.2015 also there was no representation on behalf of the petitioner and hence, the matter was ordered to be posted under the caption 'for dismissal'. Even today, when the matter has come up, none appears for the petitioner and there is no representation on his behalf.

Therefore, the Writ Petition is dismissed for nonprosecution. The amount of Rs.50,000/- deposited by the petitioner shall be adjusted against his loan account. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
