THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.3051 OF 2013 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed assailing the order dated 07.05.2013 in O.S.No.308 of 2013 passed by the X Junior Civil Judge, City Civil Court, Hyderabad, whereby the Court below decided the issue of res judicata as preliminary issue under Order XIV Rule 2 of CPC and also held that the said suit is not barred by res judicata. However, as there was no stay during the pendency of this revision, the suit itself was disposed of by the trial Court on 12.07.2013. Therefore, nothing survives for adjudication in this revision.

Hence, the Civil Revision Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this petition shall stand closed.
