THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.12663 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/A.3 in C.C.No.678 of 2015 on the file of the Court of the V Additional Judicial First Class Magistrate, Kakinada, East Godavari District. The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to avail the remedies available to him under law including filing of the discharge petition, if charges are already not framed.

Permission is granted.

Learned counsel for the petitioner submitted that the presence of the petitioner may be dispensed with before the trial Court on each and every date of adjournment. There is no dispute with regard to the identity of the petitioner. Hence, the Criminal Petition is dismissed as withdrawn. The presence of the petitioner, who is accused No.3 in C.C.No.678 of 2015 on the file of the Court of the V Additional Judicial First Class Magistrate, Kakinada, East Godavari District, is hereby dispensed with on each and every date of adjournment. However, he shall appear before the trial Court as and when his presence is so required. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
