BHATT W.P.No.8456 OF 2016 ORDER: (Per the Hon'ble Sri Justice S.V.Bhatt) The petitioner prays for the following relief: ....this Hon'ble Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the Sale Notice - E-Auction dated 09-02-2016, issued under Rule 9 of Security Interest (Enforcement) Rules 2002 by the Respondent herein and further proceeding for auction on 16-03-2016 in respect of subject property as notified in the said Sale Notice - E-Auction dt. 09-02-2016 in respect of immovable property admeasuring 1344 Sq. yards of site and building situated at Door No.6-3-680/A/B, Plot No.8, Sy.No.

35, Agri Gold Towers, Thakur Mansion Lane, Punjagutta, Somajiguda, Hyderabad, consisting of Ground Plus four upper floors belonging to the Petitioner Company contrary to the directions issued by the Hon'ble High Court in PIL No.193/2015 from time to time as illegal, arbitrary, unconstitutional, mala fide and contrary to the spirit of the orders of the Hon'ble High Court passed in PIL No.193/2015 and to consequently set aside the same and to pass...." The main challenge in this writ petition is against the auction scheduled to be held on16.03.2016. At the hearing, learned counsel appearing for parties submit that the auction scheduled on 16.03.2016 did not take place and the cause in the writ petition is rendered infructuous for the present.

The statement of learned counsel is placed on record, the writ petition is disposed of as infructuous. There shall be no order as to costs.
