V. Naga Siva E.G.Dist. v. State Of Andhra Pradesh, Rep. By Its Principal Secretary,
THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21134 OF 2016 ORDER:
Heard the learned counsel for the petitioner, learned Government Pleader for Revenue for respondents 1 to 3 and the learned Government Pleader for Mines and Geology, for respondent No.4. With consent of the counsel appearing for both sides, the present Writ Petition is disposed of at the admission stage.
2 . The present writ petition came to be filed with the following prayer:
"to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in not communicating any order relating to the grant 'No Objection Certificate' (NOC) for grant of temporary permit for gravel over an extent of Ac.3.00 cents in Ziroyati land in Sy.No.329/2 of Vemulapalli Village, Mandapeta Mandal, East Godavari District in favour of the petitioner in response to the letter addressed by the 4th respondent in Lr.No.2437/TP/2015, dated 07.08.2015 as illegal, arbitrary and unjust and consequently direct the 2nd respondent to pass appropriate orders in this regard forthwith and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
3. Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent to consider the letter dated 07.08.2015 addressed by the 4th respondent forwarding the application of the petitioner for issuance of NOC for grant of
temporary permit for mining gravel.
4. Learned Government Pleader for Revenue did not dispute the same.
5. Having regard to the facts in issue and without going into the merits of the case, the Writ Petition is disposed of directing the 2nd respondent to pass appropriate orders on the letter dated 07.08.2015 addressed by the 4th respondent with regard to issuance of NOC in favour of the petitioner for grant of temporary permit for gravel over an extent of Acs.3.00 Gts., in Sy.No.329/2 of Vemulapalli Village, Mandapeta Mandal, East Godavari District, as early as possible preferably within a period of four (04) weeks from today.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
