Mohd Bin Abdul Salam v. The State Of Telangana Rep By Its Principal Secretary,
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.24659 of 2016 ORDER :
Heard the counsel for petitioner, and the learned Government Pleader for Home (Telangana) for respondent nos.1 to 4.
2. The petitioner's grievance is that 4th respondent is not taking any action against 5th respondent in spite of the fact that Crime No.143 of 2013 was registered on 24.05.2016 before the 4th respondent on a complaint given by petitioner.
3.
The learned Government Pleader for Home (Telangana), appearing for respondent nos.1 to 4, states that notice had been issued to petitioner on 09.06.2016 to produce certain documents and witnesses to facilitate investigation, and that even though the petitioner received it, he did not appear and furnished the information sought.
4. The counsel for petitioner disputes this contention and states that his client never received the notice dt.09.06.2016.
5.
The learned Government Pleader for Home (Telangana), appearing for respondent nos.1 to 4, however states that notice dt.21.06.2016 was issued to
the accused under Section 41-A of Criminal Procedure Code.
6.
In view of these facts and circumstances, the petitioner is directed to furnish the information sought by 4th respondent within a period of one (01) week from the date of receipt of a copy of the order. Thereupon, the 4th respondent is directed to conduct investigation in accordance with law, and file a final report before the competent court as expeditiously as possible.
7. Accordingly, the Writ Petition is disposed of. No order as to costs.
8.
As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed. __________________________________ JUSTICE M.S.RAMACHANDRA RAO Date: 09-08-2016 Ndr/*
