THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE S.V.BHATT WRIT APPEAL No.1301 of 2018 JUDGMENT: (Per the Hon'ble Sri Justice S.V.Bhatt) Heard Sri T.C.Krishnan, learned counsel for the appellant, learned Government Pleader for Revenue and the learned counsel appearing for respondent Nos.1 to 3.

2.

The third respondent in the Writ Petition is the appellant. The instant appeal is filed aggrieved by the following direction issued in the order under appeal:

"In view of the above representation, the Writ Petition is disposed of directing the second respondent/Tahasildar to complete the said exercise in accordance with law as early as possible, preferably within a period of four weeks from the date of receipt of the copy of this order."

3.

We have perused the order and are of the view that the direction issued by the learned single Judge does not in fact decide or affect the rights of any of the parties in W.P.No.32307 of 2018.

4.

In that view of the matter, we clarify that respondent No.5 in the appeal, as and when proceeds to implement the order in W.P.No.32307 of 2018, affords fair and reasonable opportunity to the appellant as well as other parties before him, receives objections, enquires into the matter and passes orders in accordance with law.

With the above clarification, the Writ Appeal is disposed of.

The miscellaneous petitions pending in this appeal, if any, shall stand closed. There shall be no order as to costs. _______________________________________ THOTTATHIL B. RADHAKRISHNAN, CJ _______________________________________ S.V.BHATT, J 05.10.2018 vs
