HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 40289 of 2012 Order:

The petitioner, which is an advertising agency, was doing the business of advertising including on bus shelters at various places. The first respondent granted leasehold rights over 1167 bus shelters to seven advertising agencies including the petitioner. Out of seven advertising agencies, only three were given leases by duly following the tender process and four were given leases without following tender process. Challenging the said action of granting leasehold rights without following tender process, the petitioner filed W.P.Nos.3516 and 3518 of 2010 and the same are pending. It is the case of the petitioner that the petitioner is paying more towards lease charges to the first respondent, whereas others are paying less. The petitioner states that a representation was submitted on 25.01.

2013 to the second respondent bringing to his notice the grievance of the petitioner and it is submitted that if the said grievance is considered the petitioner would be satisfied. Though a counter affidavit is filed by the second respondent denying the averments made in the affidavit filed in support of the writ petition, in view of the request of the petitioner, this Writ Petition is disposed of, without going into the merits of the case, by directing the second respondent to consider the representation of the petitioner dated 25.01.

2013, which was received in the office of the Advertisement Section of Greater Hyderabad Municipal Corporation, Hyderabad on the same day, and pass appropriate orders thereon in accordance with law after hearing the petitioner, if necessary, within a period of three (3) months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
