HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36254 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in FIR No.345 of 2016 on the file of the 2nd respondent. 2.

Heard and perused the material available on record. 3.

The learned Counsel for the petitioner submitted that there are civil disputes between the petitioner and respondents 3 and 4 and that the present complaint has arisen out of such property disputes and that the 2nd respondent is interfering with the civil disputes and he is trying to decide the title of the properties in dispute.

The petitioners filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the circumstances of the case and the submissions made by the learned Counsel for the petitioner, this Court is of the view that the investigation can be completed without arresting the petitioner.

Accordingly, the 2nd respondent is directed not to interfere with the civil disputes of the petitioner and not to decide the title of the properties in dispute in the name of investigation. If the title of the properties in dispute is decided by the 2nd respondent it will not bind on the parties concerned. Further, the 2nd respondent is directed to complete the investigation, and file a final report in the above Crime, in accordance with law in either way, without arresting the petitioner.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
