HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18577 OF 2016 O R D E R :

The case of the petitioners is that they are having lands in Karukonda Village, Bijinapally Mandal, Mahbubnagar District and the their lands were taken up by the Government for the Palamur-Ranga Reddy Lift Irrigation Project. The petitioners are not against the project but they are against the acquiring of lands by way of G.O.Ms.No.123 (Revenue JA & LA Department) dated 30.07.2015 instead of following the provisions envisaged in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act'). It is also the case of the petitioners that their consents were obtained forcefully under threat and still they are threatening the petitioners for taking over the possession of their land by obtaining signatures on blank papers and bond papers.

Against the same, they made representation to the District Level Land Procurement Committee (DLLPC) through its chairperson detailing their objections. But without considering the said representation, the respondents are trying to dispossess the petitioners. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner, learned Government Pleader for Land Acquisition and also Government Pleader for Irrigation. Since the petitioners have ventilated their grievance to the District Collector-4th respondent, who is the chairperson of District Level Land Procurement Committee, the 4th respondent is directed to consider the representation of the petitioners before taking any further action. With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________
