HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 34859 of 2018 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the selection of the 5th respondent by the official respondents as Anganwadi Teacher for Gollacheemanapally Village, Chittoor District, as illegal and arbitrary.

Heard Sri N. Harinath, learned counsel for the petitioner, learned Government Pleader for Revenue appearing on behalf of the 2nd respondent, and learned Government Pleader for Women and Child Welfare appearing on behalf of respondent Nos.1, 3 and 4. The grievance of the petitioner is that the respondents 2 to 4 have selected the 5th respondent as Anganwadi Teacher for Gollacheemanapally Village, ignoring her merit and experience. Learned Government Pleader for Women and Child Welfare has submitted that the 5th respondent was not selected as Anganwadi Teacher and, in fact, the selection is under process. Having considered the submissions made by the learned counsel on either side and perused the record, this Court is of the view that the writ petition is premature and is liable to be dismissed. Accordingly, the writ petition is dismissed. However, liberty is given to the petitioner to pursue her remedy, if she is aggrieved by the appointment of any Anganwadi Teacher.

Consequently, miscellaneous applications, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 1st October, 2018 cbs
