THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.34861 of 2018 O R D E R:

When the matter is taken up, written instructions dated 26.9.2018 furnished by the Station House Officer, Chinthalapalem PS, Suryapet District are placed on record by the learned Government Pleader for Home. The said instructions read as under:

"It is submitted that the Chinthalapalem Police are not interfering in civil disputes between the petitioner and the 4" Respondent. The Police are also not directing the petitioner to settle the civil dispute with the 4th Respondent. The allegations to the contrary made in the Affidavit are not correct and hereby denied.

It is submitted that the petitioner herein is Accused No.2 and the 4th Respondent herein i.e., Mettu Ramalingareddy is Accused No.1 in Crime No.151/2018 u/s 465, 468, 471, 193, 196, 418, 419, 420, 504, 506 r/w 34 IPC, 156 (3) Cr.P.C. of Chithalapalem Police Station, Suryapet District. The said FIR has been registered on 25.9.2018 based on the private complaint filed by Kandula Lakshmareddy and on reference from the Hon'ble Court. The complainant has stated that he has purchased land in Sy.No.690 to an extent of Ac.1.10 guntas at Dondapadu Revenue Village of Chinthalapalem Mandel from Madhira Laxma Reddy. His name was also updated in the revenue records. However, after some days he learnt that through Meeseva computerized pahani discloses another person name i.e., Mallela Sravani instead of his name.

The accused have transferred the records without his signature and without his statement. The Accused 4 to 6 who are working at Tahsildar office, Mellacheruvu and Chinthalapalem without any relevant document, colluded with each other and clandestinely issued fake pattadar pass book and title deed in favour of the accused by altering the Survey Nos. 690/1, 690/1/1 without following the procedure and entered the name of Accused No.2 in the revenue records. The accused intentionally and knowingly forged the document and cheated and threatened, abused him in filthy language. It is submitted that, after Court endorsement, the said FIR has been registered. It is submitted that the investigation is at preliminary stage.

It is submitted that, as stated above, the Police are not interfering in civil disputes between the petitioner and the 4th Respondent herein. In fact, there is no complaint lodged by the 4th respondent against the petitioner herein. Hence, question of directing the petitioner to settle the civil dispute with the 4th respondent does not arise, and the said allegation is false, baseless and hereby denied."

On noticing the said instructions, a request is made by the learned counsel for the petitioner to dispose of the writ petition by placing on record the said instructions.

Accordingly, the writ petition stands disposed of, by placing on record the above said instructions dated 26.9.2018 furnished by the Station House Officer, Chinthalapalem PS, Suryapet. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
