THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5093 OF 2017 ORDER:

This writ petition is filed challenging the action of the second respondent in not receiving the application of the petitioner and not correcting his date of birth as 09.06.1996 instead of 09.06.1995 in his passport bearing No.F 6449884.

A counter affidavit is filed by respondents stating that they have already issued a letter on 23.02.2017 asking the petitioner to furnish the revised Birth Certificate cancelling the previous Birth Certificate and even after the said letter, the petitioner has not approached the respondents. It is also stated that the application submitted by the petitioner is pending and in view of the letter issued to the petitioner, it is for the petitioner to furnish the revised Birth Certificate.

In the circumstances, the petitioner is given liberty to take steps pursuant to the letter issued by the second respondent on 23.02.2017 for obtaining new passport with new date of birth. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 21.03.2017 pln
