HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD CRI MI NAL PETI TI ON No.7514 OF 2011 ORDER:

This criminal petition is filed under Section 482 of Cr.P.C. to quash the proceedings in Crime No.64 of 2011 registered for the offence punishable under Section 498-A IPC of Women Police Station, Charminar, Hyderabad.

Heard Sri A.Prabhakara Rao, learned counsel for the petitioners and learned Additional Public Prosecutor for the State and perused the record. Learned counsel for the petitioners submitted that in view of the interim order passed by this Court on 25.08.2011, all further proceedings in Crime No.64 of 2011 were stayed. He further submitted that instead of going into the merits of the case, a direction may be given to the police to investigate the matter by following the provision under Section 41-A of Cr.P.C.

Learned Public Prosecutor reported no objection for giving such a direction.

Under these circumstances, the Station House Officer concerned is directed to follow the provisions under Section 41-A of Cr.P.C. and abide by the directions issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1.
